Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Elo platform (the "Service"), operated by Altivum Inc. ("Altivum," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

Elo is an AI-powered coaching platform that helps users improve their articulation and communication skills through real-time voice practice with AI and detailed performance analysis. The Service includes browser-based voice practice, phone-based practice, session analysis, progress tracking, custom topics, and organization features.

2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Transmit harmful, threatening, abusive, harassing, or otherwise objectionable content
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service for any purpose other than its intended use (personal or organizational communication development)
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Use automated systems (bots, scrapers) to access the Service without our written permission
  • Resell, sublicense, or redistribute the Service without our written consent

5. Subscriptions and Payment

Certain features of the Service require a paid subscription. By subscribing to a paid plan:

  • You authorize us to charge your payment method through our payment processor (Stripe) on a recurring basis
  • Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan
  • You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of your current billing period
  • We do not provide refunds for partial billing periods unless required by law
  • We reserve the right to change pricing with 30 days' notice

6. Intellectual Property

Our Property

The Service, including its software, design, branding, AI models, analysis algorithms, and documentation, is owned by Altivum Inc. and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.

Your Content

You retain ownership of any content you create or provide through the Service, including custom topics, documents uploaded for organizational use, and your session data. By using the Service, you grant us a limited license to process your content solely for the purpose of providing and improving the Service.

7. AI-Generated Content

The Service uses artificial intelligence to generate conversation responses, session analysis, performance scores, and feedback. You acknowledge that:

  • AI-generated content is provided for educational and developmental purposes only
  • AI analysis and scores are approximations and should not be treated as definitive professional assessments
  • We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose

8. Organization Accounts

If you create or join an organization on Elo:

  • Administrators may view session reports and performance data for members within their organization's context
  • Members consent to this visibility by joining the organization
  • Organization-provided topics and documents may be used to augment your practice sessions
  • Leaving an organization revokes the administrator's access to your future sessions, but previously generated reports within the organization's context may be retained

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ALTIVUM, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Altivum and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

  • Your right to access the Service ceases immediately
  • We will delete your personal data in accordance with our Privacy Policy
  • Provisions that by their nature should survive termination will survive (including Sections 6, 10, 11, 12, and 14)

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.

15. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
